The Kimberly Process Certification is not mandatory and so far the only jeweler I've found that has signed on as a retailer in the U.S. is Zales.
Although there is no real guarantee, it's important to do your best in finding an ethical way to procure a diamond. We can't control who is lying/faking documentation, but we can do our best to follow the protocol in place with those vendors who participate in it.
There is a well-documented and regulated international process for certifying conflict-free diamonds, the Kimberley Process Certification Scheme. This has been legally implemented in many countries, including the U.S., for over 5 years now. In essence, it would be hard NOT to buy a conflict-free diamond from a U.S. dealer. Note that most conflict-free diamonds are actually mined in Canada, so find that out from your dealer.
What is Conflict-Free?
Conflict-free means the source of the diamond is a conflict-free area. Africa in its entirety may not be a conflict-free continent, with genocides and civil wars occurring in many different countries throughout, but there are places in Africa that ARE free of conflict diamonds, such as Rio Tinto.

You should be aware that brilliantearth gets it's diamonds from mining companies that also own mines in Africa, such as Rio Tinto. Anyone who claims their diamonds do not have a connection to Africa is just as much trying to make money from the hardship of others as any one. Simply ask if your jeweler can provide a written policy on conflict diamonds. There is no REAL guarantee.
